Construction Industry Fair Play Act

About

State Labor, Department of

Anyone who works for a construction business is protected by the Fair Play Act.

The law makes sure that businesses provide employees their rights. Businesses cannot term employees as independent contractors unless:

  1. The worker is free from direction and control while performing their job; and
  2. The work they do is separate from the normal work of the business; and
  3. They have an independent business.

Employees, contractors, and subcontractors that do not meet these must receive certain benefits. These include unemployment insurance, worker's compensation, and overtime. Payment for wages must be on time and be above minimum wage. All are entitled to a safe work environment.

Businesses must post the required notice about the Act in places of work. The notice must be posted in Spanish if many workers speak Spanish.

Businesses that break the law will be punished.
